CONDITIONS OF HIRE
ABC Function Hire

By interacting with ABC Function Hire whether by requesting a quotation, making a payment, confirming a booking, collecting, or accepting delivery of equipment—the customer is deemed to have read, understood, and accepted these Terms & Conditions, including all disclaimers and responsibilities stated herein.

 

1. Hire of Equipment / Booking Confirmation

Please note: A quotation is not a confirmed booking.
1.1 A booking is only confirmed once 50% of the total invoice amount has been paid. If this payment is not received, the booking will be considered incomplete, and the items may be allocated to another customer without prior notice.
1.2 ABC Function Hire hires to the customer the items described on the invoice or order form.
ABC Function Hire hires equipment to the person or business listed on the invoice—not to their clients, guests, or other third parties. For example, if you are a caterer or event coordinator, you are our client, not your end-user. You are fully responsible for the hired items. Each party elects the address listed on the invoice as their legal address for notices, legal service, and all official communication.
1.3 A single mock setup may be arranged only at an ABC Function Hire office once a confirmed booking (50% payment) has been made. Mock setups are strictly by appointment only, must be scheduled in advance for a later date, and will only take place on ABC Function Hire premises.

1.4 Upon delivery or collection of the Equipment, the customer must sign a delivery/collection form confirming receipt of the items as per the invoice. This signature constitutes acceptance of the Equipment in its stated condition.

1.5 It is the client’s sole responsibility to review the invoice and confirm that all details ,such as event date, delivery/collection time, item list, and physical address are accurate. Any amendments, additions, or corrections must be communicated in writing before delivery. ABC Function Hire will not be held liable for errors or omissions not reported by the client in advance.

1.6 Full payment must be made before delivery or collection. If paying via EFT, the payment must reflect in our bank account before we proceed with delivery or collection.

 

 

2. Deposit and Hire Charges

2.1 Hire charges and deposits are payable in full on delivery or collection, unless otherwise agreed in writing. The deposit, less any deductions, will be refunded within a reasonable period after return or collection of the Equipment.
2.2 Deposits paid to secure bookings will be forfeited if the booking is cancelled within 30 days of the event date.
2.3 Refunds (including deposit refunds) are processed monthly between the 5th and 15th of the following month. Please email: refunds@abcfunctionhire.co.za with your name and event date as the subject line.

2.4 Cancellations made more than 30 days before the reserved date will incur a 20% handling fee.
2.5 A mandatory wash-up fee will be charged for crockery & cutlery.

 

3. Customer Consultations and Collections

3.1 Walk-in customers are welcome; however, consultations are limited to 30 minutes per customer unless a prior appointment has been made.
3.2 Booked appointments take priority, and walk-in clients may be required to wait until scheduled consultations are completed or to schedule a confirmed appointment for another time.

3.3 Customers who collect equipment will be required to complete a FICA process. A valid South African ID or company registration document, along with a recent proof of address, must be provided before collection.
3.3 Collections from any ABC Function Hire branch are strictly on a first-come, first-served basis.

3.4 If you collect the equipment, you are responsible for returning it in full by the agreed time and ensuring it is checked in with a representative from ABC Function Hire.

3.5 Upon return of hired items, a representative of ABC Function Hire must inspect the items in the presence of the client or a representative of the client. Where applicable, the deposit will be refunded at that time, and a signature from the client or their representative will be required to confirm the return. If there are any damages or missing items not covered by the deposit, payment must be made immediately.

 

4. Communication and Quotation Requests

4.1 To ensure accuracy and efficiency, ABC Function Hire does not accept quotation requests via WhatsApp or telephone. All requests must be submitted in person, via email, or through our official website/s to ensure details are documented and traceable.
4.2 Email requests must be sent to one designated office only; sending the same request to multiple offices will cause delays and will not be processed.
4.3 The WhatsApp line is strictly for emergencies and will not be responded to after office hours.

 

5. Hire Period

5.1 The hire period begins when the Equipment is delivered or collected and ends when ABC Function Hire formally accepts its return.
5.2 While ABC Function Hire will take all reasonable steps to ensure timely delivery and collection, it shall not be held liable for any delays. Please note that deliveries made one day prior to the event date are not considered late.
5.3 Equipment returned late will be subject to daily late fees calculated as:
  (Price of Item) × (Quantity) × (Number of Days Overdue)

 

6. Equipment Condition

6.1 Equipment is deemed to be in good condition and fit for purpose upon delivery or collection, unless the customer immediately reports any issues to ABC Function Hire or its representative.
6.2 ABC Function Hire may, at its discretion:
• Cancel the agreement and refund the customer.
• Replace or repair faulty items.
• Remedy any delivery discrepancies.

 

7. Care and Return of Equipment

7.1 The customer agrees to:
• Notify ABC Function Hire immediately of any malfunction.
• Return the Equipment in a clean and undamaged condition.
• Wash and dry all items (excluding tablecloths, furniture, and marquees). A wash-up fee will apply to unwashed items.
• Avoid applying any foreign substances (e.g., stickers, glue, paint, candle wax, glitter, décor tape) to the Equipment. A cleaning/removal fee will be charged for any such residue found on return.
• Note that ABC Function Hire does not provide post-event cleanup services. All items must be returned in boxes and crates as originally delivered. A flat R1500 clearance fee will be charged for any items not properly packed or left scattered on-site.
7.2 The customer is liable for the full replacement value of any Equipment lost, damaged, or stolen.
7.3 No substitution of ABC Function Hire’s Equipment with other items is permitted.
7.4 Unless the Equipment is checked and signed off upon return in the presence of an ABC Function Hire representative, the company’s records will be final and binding.

 

8. Use of Equipment

The customer:
8.1 Confirms awareness of the Equipment’s intended purpose and agrees to use it accordingly.
8.2 Uses the Equipment at their own risk and indemnifies ABC Function Hire against all claims, including third-party injuries, damages, or losses.
8.3 Waives any claims against ABC Function Hire for damages or losses, including but not limited to installation issues, equipment failure, or service delays, beyond the remedies provided in this agreement.

 

9. Warranties

ABC Function Hire provides no warranties beyond what is stated in this agreement. Any additional terms must be agreed to in writing.

 

10. Access

ABC Function Hire reserves the right to access the customer’s premises during reasonable hours for equipment inspection or servicing.

 

11. Breach of Agreement

11.1 ABC Function Hire may cancel this agreement and retrieve Equipment if the customer:
• Fails to fulfill their obligations within 3 days of written notice.
• Becomes insolvent, liquidated, or placed under judicial management.
11.2 This cancellation is without prejudice to any other legal remedies, including claims for consequential damages.
11.3 ABC Function Hire’s liability, regardless of cause, is limited strictly to the remedies outlined in this agreement.

 

12. Legal Provisions

12.1 The customer consents to the jurisdiction of the Magistrate’s Court in the district of their listed address.
12.2 The customer is liable for all legal costs (on attorney and own client scale) arising from any breach of these conditions.
12.3 ABC Function Hire may allocate any payment received toward any existing obligation, whether related to this hire agreement or otherwise.

 

13. Delivery Restrictions

ABC Function Hire will only deliver to ground-level locations. Deliveries to upper floors or basements are not provided unless pre-arranged in writing. Additional charges may apply.

 

14. General Disclaimer and Equipment Use Responsibility

14.1 ABC Function Hire (Pty) Ltd supplies all equipment in good working condition. All equipment is hired and used at the customer’s own risk. ABC Function Hire shall not be held liable for any injury, loss, damage, or claim arising from the misuse of equipment, negligence, failure to follow safety instructions, or circumstances beyond our control.

14.2 The customer is fully responsible for ensuring that:

•Equipment is unplugged or turned off after use.

•All hired machines and items are stored safely and securely when not in use.

•Outdoor equipment is brought indoors or properly protected during bad weather (e.g. rain, wind, excessive heat).

•Equipment is stored in a dry, covered location where it will not be exposed to damage, moisture, theft, or misuse.

14.3 Failure to adhere to these care and safety guidelines may result in:

Additional charges for cleaning, repair, or replacement.

Partial or full forfeiture of the security deposit.

Note: We do not provide extension cords, plugs, or power adapters for any electrical equipment. Customers must ensure suitable power sources and accessories are available on-site.

 

TERMS AND CONDITIONS FOR INFLATABLES (JUMPING CASTLES)

❌ No eating, drinking, or smoking on or near the inflatable.
❌ No shoes, sharp objects, or face paint allowed on the inflatable.
⌛ Must be returned by 10:00 AM the following business day (unless prior arrangements have been made), or a full additional day’s hire fee will be charged.
Customer is fully responsible for any loss or damage to the jumping castle or its accessories.
Standard accessories include:
  • 0.75kW or 1.1kW Blower Fan (220V)
  • Carry Bag
⚠️ Risk transfers to the customer upon delivery or collection.
ABC Function Hire is not liable for injuries or damages resulting from the use of the inflatable.

 

Set-Up Instructions

Unfold the jumping castle on a flat surface.

Tie the blower fan to the air inlet using the provided rope.

Connect the blower to a power source using an extension cord.

Wait approximately 5 minutes for full inflation.

 

Pack-Up Instructions

Turn off the blower.

Allow 15 to 20 minutes for complete deflation.

Fold each side halfway inward.

Roll tightly from one end.

Place into the carry bag for return.

 

⚠️ Important Notices

No refunds will be issued due to bad weather.

Any damage will result in a charge based on the cost of repair or replacement.

If the inflatable is not returned by 10:00 AM the next day, a full extra day’s hire fee will apply.

Any foreign substances (e.g., stickers, wax, glitter, paint) found on return will incur an additional cleaning or removal fee.
